The trial of attorney Claud ‘Tex’ McIver resumes on in Georgia on Wednesday. McIver is accused of murdering his wife Diane McIver on Sept. 25, 2016. Tex McIver admits to shooting Diane, but he claims it was an accident.
McIver claims he was sitting in the backseat of a car while holding a gun as he rode with his wife and their friend in a suspicious neighborhood that he was not familiar with. Diane was seated in the front passenger seat. McIver’s defense claims that he fell asleep, woke up suddenly, and accidentally fired the weapon, which resulted in Diane getting shot through the back of her seat. Before she died, Diane McIver was said to have said it was an accident.
The prosecution rested their case on Tuesday after calling dozens of witnesses over the course of more than two weeks. Their theory is that Tex McIver intentionally killed his wife for her money. Witnesses testified as to how the couple maintained individual finances, and how Tex sold Diane’s possessions upon her death.
The defense called their first witness on Tuesday, McKenzie Davenport. Davenport is the Chief Financial Officer of a company in which Tex owned a 10 percent stake before selling his interest in the company for $700,000 in January 2017.
Davenport will continue to testify on Wednesday.
