The U.S. Supreme Court granted a temporary stay of a District Court order against the Trump administration’s transgender military ban. This is the second recent decision related to the ban that has been favorable to the government.
On Dec. 22, 2017, the district court ruled against Trump, issuing an injunction against the transgender ban. In an order issued Tuesday morning, the Supreme Court put that injunction on hold “pending disposition of the Government’s appeal in the United States Court of Appeals for the Ninth Circuit and disposition of the Government’s petition for a writ of certiorari, if such writ is sought.”
The Supreme Court’s order stated that after the Trump administration’s appeal before the Ninth Circuit is done, if they then try to get the case heard by the Supreme Court, the stay on the lower court’s order will stay in effect until either the Supreme Court decides not to hear the case, or—if they do hear the case—until the Court enters judgment.
The Supreme Court’s order specifically noted that Justices Elena Kagan, Ruth Bader Ginsburg, Sonia Sotomayor, and Stephen Breyer would have denied the application for a stay of the injunction.
In early January, the Trump administration received another favorable ruling related to the transgender ban, when the D.C. Circuit Court of Appeals vacated a separate injunction against it.
