The murder trial of Atlanta lawyer Claud ‘Tex’ McIver continues on Tuesday. McIver is accused of murdering his wife Diane McIver on Sept. 25, 2016. He claims it was an accident. Watch live on the Law&Crime Network in the player above.

McIver has said that he was holding a gun while seated in the backseat of a car for protection as he rode with his wife and their friend Dani Jo Carter through what he felt was a dangerous neighborhood, with Carter driving. At some point, he claims, he fell asleep, and then awoke with a start and accidentally fired the weapon, shooting Diane through her seat in the process. Diane was taken to a local hospital. Tex’s defense claims that before she died, Diane said the shooting “was an accident.”

The prosecution’s theory of the case has been that McIver intentionally killed his wife for her money. Much of Monday’s testimony dealt with Diane’s assets and her will. Anne Schwall, whose son Austin was the McIver’s godson, testified that Tex told her he regretted that he and Diane had not changed their wills to leave Diane’s ranch to Austin. Schwall said Tex later told her he changed his will.

An attorney who met with the McIvers in 2011 to work on their wills said that Diane’s last will was from 2006. While they had discussed making changes in 2011, ultimately no new will was made, but the lawyer, Harald Hudson, said that both Diane and Tex had expressed leaving the ranch in a trust to Austin after they both died.
