The murder trial of lawyer Claud ‘Tex’ McIver continues Thursday in Fulton County, Georgia. McIver is accused of murdering his wife Diane McIver on Sept. 25, 2016. He claims it was an accident. Watch live on the Law&Crime Network in the player above.
McIver has said that he was holding a gun while seated in the backseat of a car for protection as he rode with his wife and their friend Dani Jo Carter through what he felt was a dangerous neighborhood, with Carter driving. At some point, he claims, he fell asleep, and then awoke with a start and accidentally fired the weapon, shooting Diane through her seat in the process. Diane was taken to a local hospital. Tex’s defense claims that before she died, Diane said the shooting “was an accident.”
Carter took the stand for the third day on Wednesday, this time discussing the aftermath of Diane’s death. She mentioned how a few days after the shooting, she found out that Tex was selling Diane’s possessions. She also recalled how Diane could get irritated with Tex on occasion. She said on the day she died, when the three of them were at dinner, Diane was criticizing Tex over his eating. Carter also talked about an incident in the past, where Tex and Diane had an argument and shoved each other. Carter said both Tex and Diane had been drinking, and she had never seen them act like that before.
Earlier in her testimony, Carter had said that she didn’t see any signs of problems.
Carter’s husband Tom also testified, talking about how McIver tried to influence Carter’s response to Diane’s death. Tom Carter said that Tex was upset that Dani Jo hired a lawyer because it made him look guilty, and that he told Dani Jo to give a press statement.
