One week ago, Dr. Joseph Yurich was found guilty of vehicular homicide and leaving the scene of an accident, after his boat crashed into another on an Ohio lake, killing Brian Cuppett and injuring Bruce Lindamood. The judge, who heard the case in a bench trial instead of a jury, decided that there was not enough evidence to prove that Yurich was impaired by alcohol at the time of the crash, so he found Yurich not guilty of aggravated vehicular assault and operating a watercraft while impaired, which were the more serious charges in the case.
Yurich had given blood and urine samples to test his blood alcohol content, but the test results were ruled inadmissible in court because the samples had not been refrigerated according to state health regulations. The test results reportedly showed that Yurich’s blood alcohol content was .152, nearly twice the legal limit of .08.
