In what likely to become a contentious move, Hillary Clinton’s presidential campaign is targeting broadcasters who are airing attack ads from pro-Donald Trump PACs. According to a report from CNN on Monday afternoon, the Clinton campaign is sending cease and desist letters to television and/or radio stations who air ads that describe her as being “under investigation by the FBI.”
The letter, sent by Clinton general counsel Marc Elias, says that “These ads falsely claim Secretary Clinton is under investigation by the FBI,” even though “at no point” did the Bureau ever actually ”reopen” the investigation into Clinton’s use of a private email server while Secretary of State. “Therefore the claim in these ads is provably false,” Elias concludes. Before news broke about the letters, which were sent on Sunday after FBI Director James Comey’s own letter about Clinton went out, Trump campaign manager Kellyanne Conway told CNN’s Anderson Cooper that the ads focusing on the investigation may need to be re-cut.

In February, Trump’s lawyers sent their own cease and desist letter to the campaign of Ted Cruz, alleging that an ad portraying Trump as “pro-choice” was false. Cruz responded by holding a news conference where he dared Trump to sue him.”I have to say to Mr. Trump, you have been threatening frivolous lawsuits for your entire adult life,” said Cruz. “If you want to file a lawsuit challenging this ad, claiming defamation, file the lawsuit.”
