(4) Does the law allow jail time for those who fail to properly report abuse? Yes; the penalty is a Class B Misdemeanor (punishable by up to 90 days in jail and a $250 fine) for the first offense. A second offense is a Class A Misdemeanor (90 days to 12 months in jail; fines up to $500). A third or subsequent offense is a Class D Felony (one to five years in prison)
