The murder trial of Atlanta lawyer Claud ‘Tex’ McIver continues on Thursday. McIver is accused of murdering his wife Diane McIver on Sept. 25, 2016. He claims it was an accident. Watch live on the Law&Crime Network in the player above.
McIver has said that he was holding a gun while seated in the backseat of a car for protection as he rode with his wife and their friend Dani Jo Carter through what he felt was a dangerous neighborhood, with Carter driving. At some point, he claims, he fell asleep, and then awoke with a start and accidentally fired the weapon, shooting Diane through her seat in the process. Diane was taken to a local hospital. Tex’s defense claims that before she died, Diane said the shooting “was an accident.”
On Wednesday, much of the testimony dealt with the McIver’s respective assets. Video clips were shown of Tex stating that he had more money than his wife, including quotes like, “guns aren’t my thing [and] while she was very successful in her own right I was more,” and “I’m worth two times her estate.”
Despite this, Francis Dean Driskell, III, an accountant hired by the state to investigate Tex McIver’s finances at the time of Diane’s death, said that Tex was “cash poor,” spent more money than he made, and that he’d be in the negative if it wasn’t for his wife. Driskell said that when Tex described his net worth, he was including assets that were really Diane’s.
