The murder trial of lawyer Claud ‘Tex’ McIver continues Wednesday in Fulton County, Georgia. McIver is accused of murdering his wife Diane McIver on Sept. 25, 2016. He claims it was an accident. Watch live on the Law&Crime Network in the player above.
McIver has said that he was holding a gun while seated in the backseat of a car for protection as he rode with his wife and their friend Dani Jo Carter through what he felt was a dangerous neighborhood, with Carter driving. At some point, he claims, he fell asleep, and then awoke with a start and accidentally fired the weapon, shooting Diane through her seat in the process. Diane was taken to a local hospital. Tex’s defense claims that before she died, Diane said the shooting “was an accident.”
Carter testified for the second day on Tuesday, and she again discussed her history with the McIvers. She talked about Tex’s history with guns and how good of a shot he is. On cross-examination, she talked about Tex and Diane’s relationship. She said she wasn’t aware of any problems in their relationship.
Discussing the shooting, Carter acknowledged that when Tex asked Diane to hand him the gun while they were driving in an unfamiliar neighborhood, no one objected. She also discussed how Tex had a condition where he would be confused upon waking up, not knowing the difference between his dreams and reality. It also came up that when Tex would dream, he would lash out, causing Diane to fear that he’d hit her.
Carter is expected to continue testifying on Wednesday, as the prosecution conducts their re-direct examination.
