The penalty phase in the Cherish Perrywinkle murder case begins Tuesday. Donald Smith was convicted of kidnapping, rape and murder of the 8-year-old girl.
Jurors will now decide if he lives or dies.
Donald Smith’s son is among the eleven witnesses listed for the defense.
In 2013, Donald Smith befriended Cherish’s mother at a General Dollar store. He offered to buy her daughter a dress at Walmart. The mother and daughters rode with Smith to Walmart. After shopping for awhile, Smith lured the 8-year-old out of the store and into his van. Her body was found the next morning.
