The trial of David “DJ” Creato Jr. continues Thursday morning in Camden County, New Jersey. Creato is accused of murdering his 3-year-old son Brendan and leaving the body in a park on October 13, 2015. Creato, who maintains his innocence, was the one who reported his son’s disappearance that morning. Authorities found Brendan’s body a few hours later, at a location just a few blocks from their apartment. Prosecutors say half of Brendan’s body had been submerged in a creek, and that he died from either drowning or suffocation.
On Wednesday, Dr. Gerald Feigin, the Camden County Medical Examiner took the stand. Defense attorney Richard Fuschino Jr. is basing part of his case on the theory that Feigin’s office did not adequately examine Brendan Creato. Feigin did not respond to the crime scene, and the defense argues that the area could have been contaminated before Feigin performed any analysis. Fuschino Even though Feigin and two other pathologists examined the boy’s body, none of them could decide on a definitive cause of death. Still, he has said that the boy died as a result of “homicidal violence.” Fuschino grilled Feigin on this conclusion, pointing out that drowning or suffocation could be accidents. Feigin said that the fact that the child was found in the park wearing clean socks indicated that he did not walk there himself, which was a factor in his conclusion of homicide.
Court is scheduled to resume at 9:00 am ET Thursday morning.
