A hearing is taking place in a Massachusetts courtroom Tuesday morning, where a judge will determine whether to posthumously clear Aaron Hernandez for the murder of Odin Lloyd.
Hernandez was serving a life sentence for Lloyd’s murder when he was found hanging in his cell on April 19. His attorneys argue that the conviction should be wiped from his record due to the little known doctrine of abatement ab initio. The law, which is rooted in English common law, says that if a defendant dies before they have exhausted the appeals process, their case reverts back to before it began, rendering them not guilty. Hernandez was in the middle of appealing his conviction for Lloyd’s murder when he died.
